The law, knot by knot
Six things every adult in Galway should know before the next session, the next festival or the next Garda checkpoint.
No legal amount
Possessing cannabis is a criminal offence in Ireland, whatever the amount and wherever you are.
First offence
Gardaí may use an adult caution for a first possession for personal use, and a health-led HSE referral is being introduced. It depends on them, not on you.
In court
On conviction for possession for personal use: a fine the first two times. From the third, a prison sentence is possible.
Search powers
Gardaí can stop and search you, or your car, if they reasonably suspect you have drugs.
Sharing is supply
Passing cannabis on, even for free, is supply. Large amounts (€13,000 or more) carry a presumptive 10 years.
A record follows you
A drug conviction can matter for jobs, and countries like the United States and Canada can refuse you entry.
Quick tool
Festival season: what if…?
Galway lives for its festivals. Tap a situation to see what the law says and what to do. General information only, not legal advice.
Pick a situation to hoist the answer.
Stay calm and ask why
Gardaí can search you, and hold you for the search, if they reasonably suspect you have drugs. Ask the reason, give your name and address, and don't resist or run. If you are arrested, you have the right to talk to a solicitor.
A dog can start a search
A sniffer dog reacting to you can give Gardaí the reasonable suspicion they need to search you. If you have nothing on you, nothing happens. If you do, it is possession like anywhere else.
Security checks, Gardaí act
Bag checks can be a condition of entry: security may turn you away, and drugs they find can be handed to the Gardaí. A festival is not a legal bubble.
No is a full answer
Taking even a little is possession, and what goes round at events can contain synthetic cannabinoids or other substances. You never have to accept anything.
Get help straight away
Stay with them, find the medical or welfare tent, or call 112. Tell the medics what was taken: it helps them treat your friend quickly.
Leave the car
Gardaí often run checkpoints after big events. Above 1 ng/ml of THC, a conviction means at least a one-year driving ban. Take the shuttle, a bus, a taxi or the train.
Look after yourself
Help and harm reduction
- At festivals, drink water, rest in the shade or the chill-out area, and keep an eye on your friends.
- Edibles can take up to two hours. Never take more because nothing seems to happen.
- Synthetic cannabinoids sold as weed have sent people to hospital. Collapse or seizures: 112 or 999.
- If cannabis starts to take over your studies, work or sleep, talk to someone early.
Frequently asked questions
Is weed legal in Galway?
No. Possessing cannabis is a criminal offence everywhere in Ireland, and Galway's festivals are no exception.
Can Gardaí search me for cannabis?
Yes, if they reasonably suspect you have drugs, under section 23 of the Misuse of Drugs Act. Stay calm, ask the reason and don't resist.
Are CBD products legal in Ireland?
CBD products are sold in shops, but THC remains a controlled drug, and hemp flowers containing it can still be seized.
Does a cannabis conviction affect travel?
It can. Some countries, such as the United States and Canada, can refuse entry to people with drug convictions.
Can I drive the morning after?
Maybe not: THC can stay above Ireland's limit of 1 ng/ml long after the effect fades, and roadside saliva tests are common after big events.
